Terms of Use

1. Eligibility

The Services are built for tertiary students and users aged 18 and above. By using them you confirm that you are at least 18, or that you are under 18 and using the Services with the consent of a parent or guardian, as the Nigeria Data Protection Act 2023 requires for anyone under 18. The Services are not intended for children under 13. We do not ask for your date of birth and cannot verify age ourselves, so this confirmation is yours to make honestly.

2. Your account

You sign in with Google; we do not manage passwords. You are responsible for the activity on your account and for keeping your device and Google account secure. Provide accurate profile information (such as your university and department) and keep it up to date. Tell us at [email protected] if you suspect unauthorised use of your account.

3. Acceptable use

When using the Services, you agree not to:

• Break the law or infringe anyone’s rights, including copyright.
• Upload content that is unlawful, harmful, misleading, defamatory, or that you do not have the right to share.
• Cheat, manipulate leaderboards or scores, or interfere with the fairness of the platform.
• Attempt to gain unauthorised access, probe or breach security, scrape at scale, or overload the Services.
• Reverse engineer, resell, or commercially exploit the Services without our written permission.
• Impersonate others or misrepresent your affiliation.

4. Your content

“Your content” means anything you submit, such as study notes, files, questions, or requests. You keep ownership of your content. By submitting it, you grant My Genius a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt, and display it for the purpose of operating and improving the Services and making it available to other students.

You confirm you have the right to share what you upload and that it does not infringe anyone’s rights or breach any exam, institutional, or confidentiality rules. We may review, moderate, edit, or remove content — including questions generated from your uploads — before or after it appears, and we are not obliged to publish anything.

5. Educational content & AI

My Genius is a study aid, not an official source of truth. Quiz questions, AI-generated summaries, and other learning material may contain errors or omissions and are provided for practice only. Always verify against your course materials and lecturers. My Genius is not affiliated with, endorsed by, or an agent of any university, and using it does not guarantee any academic result.

6. The WhatsApp assistant

My Genius has an assistant on WhatsApp. It is how your reading plan reaches you, and it answers questions about your courses and your account.

It is task-specific. It exists to help you use My Genius and to support your reading, and it will decline anything else. It is not a general-purpose AI, it will not write your assignments, and asking it to is not a use we support.

You start the conversation, and you can end it. We only message you proactively for the reminders you set up yourself, and telling the assistant to stop works. Standard WhatsApp and mobile data charges from your own provider are yours.

Linking your number to your account is a deliberate step you take, and until you take it the assistant cannot see your scores or your plan. WhatsApp is Meta’s service and your use of it is also subject to Meta’s terms. What the assistant says is generated, so Educational content & AI applies to it too: treat it as a study aid, not as an authority.

7. Donations

Donations are voluntary and help keep the Services running. They are processed by our payment partner; we never receive your card or full bank details. Unless required by law, donations are non-refundable. If a payment is charged in error, contact [email protected] and we will look into it. Donating does not purchase any product, guarantee, or preferential treatment, though we may recognise supporters (for example on a donor leaderboard).

8. Paid features

Some features are paid: the reading plan, the accountability reminders that go with it, and unlimited quizzes. Searching for a course and taking a quiz stay free, up to a daily number the app shows you.

What you are buying. One month of access, at the price shown in the app before you pay. Paying is a bank transfer to a temporary account we generate for that one payment.

It does not renew itself. There is no card to link and nothing stored that could take money from you again, so there is nothing to cancel: a month simply ends unless you choose to pay for another. We will remind you before it runs out.

A short grace period after a month ends keeps the features working, so a late transfer does not interrupt your reading. The app shows how long it is. It is a courtesy and not part of what you paid for.

When a month ends, the paid features stop and nothing is deleted. Your plan, the order of your topics and every score stay exactly where they are, and paying again picks them up from there.

Refunds. If a payment is taken in error, taken twice, or the paid features did not work for you, tell us and we will refund it. Beyond that, we will refund a month in full if you ask within 7 days of paying and have not used the paid features in that time. We do not refund part of a month. Ask us at [email protected] or from the billing screen in the app, and tell us what happened.

Prices can change. A change only ever applies to a month you have not yet paid for, never to one you already have.

Paying does not change the nature of the Services: Educational content & AI, Disclaimers and Limitation of liability still apply, and paying is not a guarantee of any academic result.

9. Intellectual property

The Services, including the My Genius name, logo, design, and software, are owned by OYEN INDUSTRIES and protected by intellectual property laws. We grant you a limited, personal, non-transferable licence to use the Services for their intended purpose. All rights not expressly granted are reserved.

10. Third-party services

The Services rely on third parties: Google (sign-in, and notifications to the app), Groq (our AI provider, which handles study summaries, marking written answers, turning uploaded notes into questions, and the WhatsApp assistant’s replies), Cloudinary (file hosting), Meta Platforms (WhatsApp messaging), and Paystack and SafeHaven MFB (payments and donations). Your use of those features may also be subject to the relevant provider’s terms. We are not responsible for third-party services we do not control. Our Privacy Policy sets out what each of them receives.

11. Availability & changes to the Services

We are a small, student-built team and offer the Services on an evolving basis. We may add, change, suspend, or discontinue features at any time, and we do not guarantee uninterrupted or error-free availability. We will try to give reasonable notice of significant changes where we can.

12. Disclaimers

The Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law. You use the Services at your own discretion and risk.

13. Limitation of liability

To the fullest extent permitted by law, My Genius and OYEN INDUSTRIES will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of data, academic outcomes, profits, or goodwill, arising from your use of the Services. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

14. Termination

You may stop using the Services and request account deletion at any time, from your profile in the app, at Delete your account or data, or by contacting [email protected]. A paid month simply ending is not termination: your account and everything in it remain, and only the paid features stop. We may suspend or terminate access if you breach these Terms, misuse the Services, or where necessary to protect users or comply with the law. If we terminate your account for a reason that is not your breach while you have paid time remaining, we will refund the unused part. Provisions that by their nature should survive termination (such as content licences already granted, intellectual property, disclaimers, and liability limits) will continue to apply.

15. Governing law

These Terms are governed by the laws of the Federal Republic of Nigeria, and any disputes are subject to the jurisdiction of the Nigerian courts. Our handling of personal data also follows the Nigeria Data Protection Act 2023, as described in our Privacy Policy.

16. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Continuing to use the Services after an update means you accept the revised Terms.
